Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION NO. 97-03-061 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT /10419 AND DECLARING TERMS OF PERMIT TO <br />GRADE AND EXPORT SOILS <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution No. 99-03-060 adopting Findings <br />of Fact #0419 for this use and herein approves the Conditional Use Permit subject to the following <br />conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On March 25, 1997 a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") to <br />Eric Thomsen ("Permit Holder") for grading operations on the property legally described as follows: <br /> <br />That part of the Southwest Quarter of the Southwest Quarter of Section 2, Township 32, <br />Range 25, Anoka County, Minnesota, lying northerly of the centerline of Trott Brooks, <br />subject to easement of record; <br /> <br />-and- <br /> <br />The Northwest Quarter of the Southwest Quarter of Section 2, Township 32, Range 25, <br />Anoka County, Minnesota, lying southerly of County Road #63.' <br /> <br />("Subj eot Property:") <br /> <br />This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br />conditions of this permit are as follows: <br /> <br />This permit shall expire two (2) years from the date of commencement of operations and the <br />Permit Holder shall be responsible for providing the City with at least 48 hours advance <br />notice of the date of commencement of operations, However, the total time frame from date <br />of permit approval through operations shall not exceed the three (3) year maximum time <br />frame established by City Code. <br /> <br />All grading operations shall be conducted in accordance with the grading plan dated January <br />14, 1997, Revision Date March 17, 1997, prepared by E.G. Rud & Sons, Inc. The proposed <br />area to be graded is roughly nine (9) acres in size. Excavation shall be confined to a five (5) <br />acre area at any time. Continuation of grading shall require finished grade areas to be <br />restored with six (6) inches of topsoil, seed and disc anchored mulch. <br /> <br /> <br />
