4 <br /> <br />Ow <br /> <br />10. <br /> <br />All equipment used for grading and hauling operations shall be maintained and operated in <br />such a manner to minimize noise, dust, and vibrations adversely affecting surrounding <br />properties. All equipment shall be kept in good repair. Failed equipment and rubbish shall <br />be removed from the work site regularly. <br /> <br />The ingress and egress to the Subject Property shall be from County Road #63. The Permit <br />Holder shall provide a 75 foot long gravel approach at the access points onto County Road <br />#63 to minimize the tracking of grading materials from the site onto the public highway. The <br />Permit Holder shall be responsible for obtaining and complying with any permits deemed <br />necessary from Anoka County. In addition, the Permit Holder shall be responsible for <br />removing any spilled material from the public roads immediately upon direction to do so by <br />the City Engineer. Failure to do so shall be cause for the City Engineer to order the <br />necessary work to be done and billed to the Permit Holder. <br /> <br />All work sites shall be properly safeguarded to prevent the general public from depositing <br />garbage or other refuse on the work site. <br /> <br />The disturbed area shall be reforested with a like number of trees. The trees shall be of <br />similar species as those removed and shall be a minimum of 1-1/2 inches in diameter. <br /> <br />Grading operations shall be conducted in such a manner to minimize interference with the <br />surface water drainage outside the boundaries of the operation. <br /> <br />Fencing may be ordered by the City Council or City Engineer anytime the permit is in force <br />and shall be installed within 24 hours of written notice. <br /> <br />All haul roads to and from the Subject Property (County Road #63 between County Road #5 <br />and T.H. #47) shall be maintained in order to minimize dust and in a condition satisfactory to <br />the City Engineer. This work shall include application of water, bituminous material, or <br />calcium chloride to the road surface as may be necessary to alleviate dust nuisance and <br />eliminate traffic hazards. This work shall also include daily inspections of County Roads #5, <br />#63 and T.H. #47 and the removal of spillage of any materials from the operation. When <br />hauling operations are completed, the permit holder shall either restore that haul road to a <br />condition at least equal to that which existed at the time the hauling operations were started, <br />or compensate the local road authority in an amount satisfactory to that road authority and <br />concurred in by the City Engineer for the restoration of that haul road. The City Engineer <br />will then accept such restoration or concur in such financial settlement for the restoration of <br />the haul road in writing and such acceptance will relieve the permit holder of any additional <br />obligation in connection with the restoration of the haul roads. If the permit holder fails or <br />refuses to perform haul road restoration or to make satisfactory financial settlement for such <br />restoration, the City will cause the restoration work to be done and require reimbursement <br />from the financial guarantee required herein. <br /> <br />The maximum slope other than the working face shall be sloped on all sides no steeper than a <br />rate of 2 foot horizontal to 1 foot vertical.
