Board Member Holland introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #97-05-085 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0423 RELATING TO A REQUEST <br />FOR A VARIANCE TO CONSTRUCT AN ACCESSORY STRUCTURE NEARER THE <br />FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE <br /> <br /> WHEREAS, Peter and Linda Mayer, hereinafter referred to as "Applicants," have <br />properly applied for a variance from Section 9.11.02 of the Ramsey City Code to construct an <br />accessory garage nearer the front property line than the principal structure on the property <br />generally known as 7190 175th Avenue NW and legally described as follows: <br /> <br />The West 330.00 feet of the Southwest Quarter of the Southwest Quarter of Section 3, <br />Township 32, Range 25, Anoka County, Minnesota. Subject to 175th Avenue NW. <br />Subject to easements of record. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public heating pursuant to Section 9.03.05 of <br />the Ramsey City Code on May 6, 1997, and that said public heating was properly <br />advertised, and that the minutes of said public hearing are hereby incorporated as a part of <br />these findings by reference. <br /> <br />That the subject property is zoned R-1 Rural Residential and is approximately 10 acres in <br />size. <br /> <br />That the subject property is surrounded by R-1 Rural Residential zoning developed with <br />single family homes. <br /> <br />That Section 9.11.02 of the Ramsey City Code does not permit the construction of <br />accessory structures nearer the front property line than the principal structure. <br /> <br />That Section 9.20.11 of City Code requires a structure setback of 60 feet from the <br />centerline of the tight-of-way plus the local applicable setback. Therefore the minimum <br />structure setback on the subject property is 100 feet. <br /> <br />That the principal structure on the subject property was sited by the applicant <br />approximately 167 feet from the front property line due to limited buildable soils on the <br />subject property. <br /> <br />That the Applicants are proposing to construct an accessory garage approximately 40 feet <br />from the front property line. <br /> <br /> <br />
