8. That there are unique circumstances applying to the subject property that do no generally <br /> apply to other properties in the district; namely declines in topography, maturing tree <br /> growth, and location of the septic system, drainfields, and wetlands. <br /> 9. That the special conditions causing the undue hardship do not result from the actions of the <br /> Applicant. <br /> 10. That similar variances have been ranted in the R-1 Rural Residential District in the City of <br /> Ramsey. <br /> 11. That the variance requested is the minimum variance which would alleviate the hardship. <br /> 12. That the Applicants have stated that such variance is necessary for the preservation of <br /> substantial property right similar to that possessed by other properties in the R-1 <br /> Residential District. <br /> 13. That, if granted, the variance will not grant the Applicant any special privilege that is <br /> denied to other owners of lands, structures or buildings in the same district. <br /> 14. That, if granted, the variance will not be materially detrimental to the purposes of the <br /> Ramsey Zoning Chapter of other property in the R-1 Residential District. <br /> 15. That, if granted,the variance will not substantially increase the congestion of public streets, <br /> or increase the danger of fire, or endanger the public safety, or substantially impair property <br /> values with the neighborhood. <br /> The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br /> Terry, and upon vote being taken thereon, the following voted in favor thereof: <br /> Chairperson Deemer <br /> Board Member Holland <br /> Board Member Terry <br /> Board Member Jensen <br /> Board Member LaDue <br /> and the following voted against the same: <br /> None <br /> and the following abstained: <br /> None <br /> and the following were absent: <br /> Board Member Bawden <br /> Board Member Thorud <br /> Resolution #97-05-085 <br /> Page 2 of 3 <br />
