Councilmember Haas Steffen introduced the following resolution and moved for its adoption: RESOLUTION #97-05-135 RESOLUTION ADOPTING FINDINGS OF FACT #0428 TO REZONE CERTAIN PROPERTY FROM R-1 RURAL RESIDENTIAL TO R-1 URBAN RESIDENTIAL WHEREAS, the City received an application to rezone certain property in accordance with Section 9.03.03 of the Ramsey City Code. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That Jacob Barthold and Peter Barthold and Jane Peacapio, hereinafter referred to as "Applicants," has properly applied to rezone certain property from R-1 Rural Residential to R-1 Urban Residential. That the Planning Commission conducted a public hearing pursuant to Section 9.03.03 of the City Code on April 1, 1997 and May 6, 1997, and said public heating was properly advertised, and the minutes of said public heating are hereby incorporated by reference. 3. That the property proposed to be rezoned is legally described as follows: The south half of the Southeast Quarter of Section 14, Township 32, Range 25, Anoka County, Minnesota, lying west of the west right-of-way line of State Highway No. 47, EXCEPT the following: Commencing at the northwest comer of said south half of the Southeast Quarter of Section 14, thence with the south line of said south half North 89 degrees 45 minutes 41 seconds East, on an assumed beating basis, 1327.72 feet to the point of beginning herein; thence continuing with said south line North 89 degrees 45 minutes 41 seconds East, 808.12 feet to the computed west tight-of-way line of State Highway No. 47; thence South 14 degrees 38 minutes 31 seconds East, with said right-of-way line, 481.12 feet; thence South 89 degrees 45 minutes 41 seconds West, 350.00 feet; thence South 80 degrees 34 minutes 42 seconds West, 69.11 feet; thence South 89 degrees 43 minutes 44 seconds West, 119.02 feet; thence South 86 degrees 43 minutes 02 seconds West, 60.08 feet; thence South 89 degrees 46 minutes 17 seconds West, 310.00 feet; thence North 00 degrees 16 minutes 16 seconds West, 280.00 feet; thence North 18 degrees 57 minutes 52 seconds West, 63.36 feet; thence North 00 degrees 15 minutes 28 seconds West, 140.23 feet to the point of beginning herein. 4. That the total area of the property to be rezoned is approximately seventy (70) acres in size. o That the City has concluded that the Comprehensive Plan Amendment which implemented a Metropolitan Urban Service Area (MUSA) boundary expansion was properly adopted by the City.
