That with regard to the MUSA boundary as it relates to the Apple Ridge subdivision, the <br />City Attorney has been directed to research that issue and report to City Council on May <br />27, 1997. <br /> <br />o <br /> <br />That a Minnesota Supreme Court case has established a precedent that it is arbitrary and <br />capricious for a municipality to refuse to adopt a zoning ordinance implementing its <br />comprehensive plan. <br /> <br />8. That the Applicant is proposing to develop the plat with single family urban residential lots. <br /> <br />That the Subject Property is currently zoned R-1 Rural Residential and the surrounding <br />adjacent properties to the west, south and north are zoned R-1 Rural Residential. However, <br />the adjacent 40-acre parcel to the south is in the MUSA and is eligible for development at <br />urban standards with an appropriate rezoning. <br /> <br />10. <br /> <br />That Section 9.20.03 of the Ramsey City Code states that the intent of the R-1 Rural <br />Residential District is to accommodate single-family dwelling units on land outside the <br />Urban Service Area. <br /> <br />11. <br /> <br />That Section 9.20.03 of the Ramsey City Code states that the intent of the R-1 Urban <br />Residential District is to accommodate single-family dwelling units on land in the Urban <br />Service Area. <br /> <br />12. That the proposed zoning amendment will not substantially adversely impair the use or <br /> market value of any surrounding property. <br /> <br />13. That the proposed zoning amendment will not change the essential character of the area, <br /> which is residential. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Beyer, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gamec <br />Councilmember Haas Steffen <br />Councilmember Beyer <br />Councilmember Beahen <br />Councilmember Zimmerman <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />RESOLUTION #97-05-135 <br /> Page 2 of 3 <br /> <br /> <br />
