Councilmember Beahen introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #97-05-136 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0429 RELATED TO WMMI'S <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR A GROUNDWATER PUMP- <br />OUT AND TREATMENT SYSTEM <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That Waste Management of Minnesota, Inc., hereinafter referred to as "WMMI" has <br />applied to the City of Ramsey ("City") for a conditional use permit (CUP) to allow the <br />following use: <br /> <br />(a) <br /> <br />The operation of a groundwater pump-out and treatment system as part of <br />the remedial action necessary for WMMI's existing sanitary landfill on <br />property currently zoned industrial. <br /> <br />4 <br /> <br />That WMMI appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the Ramsey City Code on May 6, 1997, and that said <br />public hearing was properly advertised. Notice of said public hearing was published in <br />the City's legal newspaper, Anoka County Union and mailed notices of the public <br />hearing were sent at least ten days prior to the public hearing to property owners within <br />500 feet of the outer boundaries of the property in question. <br /> <br />That minutes of the public hearing are referenced and incorporated herein as if fully set <br />forth at this point. <br /> <br />That the property for which WMMI Seeks the conditional use permit is legally described <br />as follows: <br /> <br />The Southeast Quarter of the Northeast Quarter of Section 27, <br />Township 32 North, Range 25 West, City of Ramsey, Anoka <br />County, State of Minnesota. <br /> <br />("Subject Property") <br /> <br />o <br /> <br />That the Applicant submitted a statement of compliance with existing permit which is <br />herein incorporated by reference and hereafter referred to as "Exhibit A". <br /> <br />6.
