Councilmember Beahen introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #97-05-137 <br /> <br />RESOLUTION DECLARING CONDITIONS OF CONDITIONAL USE PERMIT FOR <br />WMMI'S GROUNDWATER PUMP-OUT AND TREATMENT SYSTEM <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution #97-05-136 adopting <br />Findings of Fact #0429, for this use, and herein approves a Conditional Use Permit subject to the <br />following conditions. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That on May 27, 1997, a Conditional Use Permit was issued to Waste Management of <br />Minnesota, Inc., hereinafter referred to as "WMMI" for: <br /> <br />(a) <br /> <br />The operation of a groundwater pump-out and treatment system as part of the remedial <br />action necessary for WMMI's existing sanitary landfill on property currently zoned <br />industrial. <br /> <br />Said activities shall be conducted on the property legally described as follows: <br /> <br />The Southeast Quarter of the Northeast Quarter of Section 27, Township 32 <br />North, Range 25 West, City of Ramsey, Anoka County, State of Minnesota. <br /> <br />("Subject Property") <br /> <br />Term. This Permit is a renewal of a previously issued Permit pursuant to Sections <br />9.03.04 of the Ramsey City Code. This Conditional Use Permit is valid through January <br />31,2001, so long as the conditions imposed herein are complied with. The conditions of <br />this Permit are as follows: <br /> <br />Permit Term Extension. The recovery and treatment process may extend for more than <br />ten years which is beyond the term of this Permit and the previous permit. The Permit <br />Holder may apply for a new CUP within 120 days prior to the expiration of this Permit. <br />A new permit may be approved by the City based on the performance of the Permit <br />Holder under this CUP. <br /> <br />Commencement of Work. Operations shall not commence until all conditions of this <br />Permit have been complied with. <br /> <br />Site Security.. The water treatment site shall be properly safeguarded to prevent the <br />general public from access to the site. <br /> <br /> <br />
