11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />18. <br /> <br />19. <br /> <br />20. <br /> <br />21. <br /> <br />22. <br /> <br />23. <br /> <br />24. <br /> <br />Commission recessed the public hearing and tabled action on the application until July 1, <br />1997. <br /> <br />That the Applicant has submitted an undated six-sheet set of grading plans. <br /> <br />That the Applicant is proposing to mine an area of 39 acres to a mean depth of 12 feet. <br />Chapter 4410 of the Minnesota Rules of 1995 requires a mandatory Environmental <br />Assessment Worksheet (EAW) for projects of this nature covering 40 or more acres, <br />excavated to a mean depth of ten or more feet. <br /> <br />That the Applicant states that the amount of fill exported from the Subject Property will be <br />approximately 800,000 yards. <br /> <br />That a portion of the proposed grading area is in the shoreland district of Sunfish Lake <br />which extends 1,000 feet from the ordinary high water (ohw) elevation. <br /> <br />That the Applicant has stated that the proposed haul route for incoming and outgoing <br />trucks will be from Sunfish Lake Blvd. at a point approximately 300 feet north of the <br />northern end of Sunfish Lake. <br /> <br />That no fill materials, except topsoil for restoration, are proposed to be imported to the site. <br /> <br />That no blasting will be employed in the grading activity. <br /> <br />That the existing drainage patterns will not be substantially altered by the proposed grading <br />plan. <br /> <br />That the grading plan proposes to install silt fence and a sulnp trench to control erosion <br />along the perimeter of the wetland in the active area. <br /> <br />That the grading operation will increase the traffic to and from the subject property for the <br />period of time the permit is in effect. <br /> <br />That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use or to the public welfare. <br /> <br />That the proposed use will not substantially adversely impair the use, enjoyment, or market <br />value of any surrounding property. <br /> <br />That the proposed use will not be hazardous to existing or future neighboring uses. <br /> <br />That the proposed use will be disturbing to existing neighboring uses during the term of the <br />permit. <br /> <br />RESOLUTION #97-07-178 <br /> Page 3 of 5 <br /> <br /> <br />
