Area Hydrologist Tom Hovey has inspected the site and submitted comments for <br />mblic record. <br /> <br />A variance was requested to Section 9.21.07, subd. 1.a. of the Ramsey City Code which requires a <br />minimum of 200 feet of lot width, 2.5 acres lot size, and a 35 foot bluff.setback or 200 foot ordinary <br />high water mark setback, whichever is greater. Section 9.21.07, subd.2.,c., I. (Critical River Overlay <br />District/Existing Lots.of Record) of the Ramsey City Code states that lots of record prior to July 29, <br />1985 (date of enactment) which do not meet the requirements of 9.21.07, Subd: I, may be allowed as <br />building sites provided: a) such use is permitted in the zoning district, b) the lot is in separate ownership <br />from abutting lands, and c) all other sanitary and dimensional requirements of 9.21 (Environmental <br />Protection) are complied with insofar as practical. <br /> <br />On July 31, 1997 we received a faxed copy of the Notice of Public Hearing for the variance hearing in <br />question. The findings of fact (City Resolution No. 97-08-188) and variance (City Resolution No. 97- <br />08-189) were received on August 11, 1997. <br /> <br />Based on our review and consideration of the information submitted by the City, the Department of <br />Natural Resources hereby certifies with conditions, the variance for lot size, lot width, and structure <br />setback from the ordinary high water mark as complying with the intent of the Minnesota Wild and <br />Scenic River Act, Minnesota Rules, parts 6105.0110, Subparts 1, 2, and 3, and the decision guides in <br />Minnesota Rules, part 6105.0230, subpart 2, item B. <br /> <br />i)NR Inforrnalion: 612-296-6157. 1-8U0-766-60(1(} · TTY: 612-296-5484. 1-800-657-3929 <br /> <br /> Ail Ihl.al Ol*lmrll..l5 I!.ll,h~scr ~ Pn.led o.
