VARIANCE, CITY r~ESOLUTiON NO. 97-08-i88 & 189, LOT i5, <br />BOWERS MISSISSIPPI ACRES, CITY OF RAMSEY, ANOKA COUNTY <br /> <br />Dear Ms. Frolik: <br /> <br />In a September 9, 1997 letter, the Department of Natural Resources certified with conditions, Mr. <br />Gary Lien's variance for lot size, lot width, and structure setback from the ordinary high water <br />mark of the Mississippi River (City Resolution No. 97-08-188 & 189). Mr. Lien demanded a <br />public hearing on the certification with conditions and a hearing date was set. Mr. Lien and the <br />Department agreed to mediation prior to the hearing. On April 9, 1998 the mediation was held <br />with Administrative Law Judge George Beck and an agreement was reached by both parties and <br />signed on that date. <br /> <br />The agreement provides for the modification of the conditions of the original certification. The <br />conditions on page 2 of the certification letter dated September 9, 1997 are replaced by the <br />following: <br /> <br />1. The structure setback shall be 120 feet from the ordinary high water level. But there shall be <br />an exception to this structure setback that shall allow encroachment of an open deck up to 10 feet <br />into the setback area. <br /> <br />2. The bluff protection area (an area 40 feet landward of the bluffiine) shall be restored by <br />planting native vegetation or allowing native vegetation to reestablish itself to provide a <br />vegetative screen for the preservation of views from the river and opposite shore. A path of up to <br />six feet in width through the bluff protection area shall be allowed to provide access to the river. <br />The bluff protection area, once restored, shall be left in a natural state. <br /> <br />3.
