Councilmember Beahen introduced the following resolution and moved for its adoption: RESOLUTION NO. 97-09-288 A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT BASED ON FINDINGS OF FACT #0443 AND DECLARING TERMS OF PERMIT TO GRADE AND EXPORT SOILS WHEREAS, the Ramsey City Council adopted Resolution No. 97-09-288 adopting Findings of Fact #0443 for this use and herein approves the Conditional Use Permit subject to the following conditions. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On September 23, 1997, a Conditional Use Permit ("CLIP") was issued by the City of Ramsey ("City") to Good Value Homes, Inc. ("Permit Holder") for grading operations on the property legally described as follows: Being out of and part of the South Half of the Southeast Quarter of Section 14, Township 32, Range 25, Anoka County, Minnesota, described as follows: Beginning at the South Quarter comer of said Section 14 thence with the west line of said Southeast Quarter, an assumed bearing basis, North 00 degrees 16 minutes 16 seconds West, 1319.54 feet to the northwest comer of said South Half; thence with the north line of said South Half North 89 degrees 45 minutes 41 seconds East, 1327.72 feet to the west line of the Southeast Quarter of the Southeast Quarter of said Section 14; thence with said west line South 00 degrees 15 minutes 28 seconds East, 200.23 feet; thence North 89 degrees 46 minutes 17 seconds East, 20.32 feet; thence South 00 degrees 16 minutes 16 seconds East, 280.00 feet; thence 89 degrees 46 minutes 17 seconds East, 310.00 feet; thence North 86 degrees 43 minutes 02 seconds East, 60.08 feet; thence North 89 degrees 43 minutes 44 seconds East, 119.02 feet; thence North 80 degrees 34 minutes 42 seconds East, 69.11 feet; thence North 89 degrees 45 minutes 41 seconds East, 384.38 feet to the traveled centerline of State Highway No. 47; thence with said centerline South 14 degrees 39 minutes 02 seconds East, 447.81 feet; thence South 89 degrees 48 minutes 48 seconds West, 62.34 feet; thence South 14 degrees 38 minutes 31 seconds East, 162.34 feet to a point of curvature of a curve concave to the Northeast; thence with said curve having a radius of 2840.00 feet, a central angle of 00 degrees 53 minutes 37 seconds, a short cord length of 44.29 feet (short cord bears south 15 degrees 05 minutes 19 seconds East) for an arc length of 44.29 feet to a non-tangent point on curve; thence South 89 degrees 48 minutes 48 seconds West, 457.52 feet; thence South 00 degrees 15 minutes 28 seconds East, 222.00 feet; thence South 89 degrees 48 minutes 48 seconds West, 1932.56 feet to the point of beginning herein containing 58.1646 acres of land area.
