Board Member Bawden introduced the following resolution and moved for its adoption: RESOLUTION #97-11-320 A RESOLUTION ADOPTING FINDINGS OF FACT #0447 RELATING TO A REQUEST FOR A VARIANCE TO THE REAR YARD SETBACK REQUIREMENTS IN THE B-3 HIGHWAY BUSINESS DISTRICT WHEREAS, Barr, Mach and Rows, Inc., hereinafter referred to as "Applicant", has properly applied for a Board of Adjustment variance from the rear yard setback requirements established in Section 9.20.23 (B-3 Highway Business District) of the Ramsey City Code on the property generally known as 7105 Hwy. #10 N.W. and legally described as follows: That part of the Southwest Quarter of the Southwest Quarter of Section 27, Township 32, Range 25, and the Northwest Quarter of the Northwest Quarter of Section 34, Township 32, Range 25, described as follows: Beginning at the point in intersection of the Northeasterly right-of-way of U.S. Trunk Highway No. 10 and a line parallel with and distant 511.5 feet East of the West line of the Southwest Quarter of the Southwest Quarter of Section 27, Township 32, Range 25; thence North and parallel with said West line of said Southwest Quarter of Southwest Quarter of Section 27, Township 32, Range 25, a distance of 147.58 feet; thence Southeasterly parallel with said Northeasterly right-of-way line of said Highway a distance of 147.58 feet; thence South parallel with said West line of said Southwest Quarter of Southwest Quarter a distance of 147.58 feet to the Northeasterly right-of-way line of said Highway 10; thence Northwesterly along the said Highway 10 a distance of 147.58 feet to the point of beginning, Anoka County, Minnesota. (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to Section 9.03.05 of the Ramsey City Code on November 4, 1997 and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. That the subject property is zoned B-3 Highway Business and is approximately .5 acres in size. 3. That the surrounding parcels are also zoned B-3 Highway Business.
