That the Applicant is proposing to construct an accessory structure on the Subject
Property.

That the required structure setbacks in the B-3 Highway Business District are 35
feet front, 10 feet side and 35 feet rear.

The proposed location of the accessory structure meets the front and side yard
setback requirements but is only 18 feet from the nearest point of the rear property
line and 31 feet from the most distant point of the rear property line.

That the Applicant has stated that relocating the accessory building southwest on
the Subject Property to meet rear yard setback requirements will deplete the
required off-street parking currently provided on the site.

That there are unique circumstances applying to the subject property that do not
generally apply to other properties in the B-3 Highway Business district; namely,
the Subject Property does not quite meet the current 1/2 acre size minimum and is
one of the smallest parcels in the Highway #10 corridor.

That the Subject Property is entitled to a building coverage of 35% of the lot area;
to achieve even the minimal 10% building coverage proposed will require some
relief from yard setback requirements so as not to deplete required off-street
parking, which is a public safety issue on Highway #10.

10.

That such variance is the minimum necessary for the preservation of a substantial
property right similar to that possessed by other properties in the B-3 Highway
Business District.

11.

That the special conditions causing the undue hardship do not result from the
actions of the Applicant.

12.

That if granted, the variance will not grant the Applicant any special privilege that
is denied to other owners of lands, structures or buildings in the same district.

13.

That if granted, the variance will not be materially detrimental to the purposes of
the Ramsey Zoning Chapter or other property in the B-3 Highway Business
District.

14.

That if granted, the variance will not substantially increase the congestion of
public streets, or increase the danger of fire, or endanger the public safety, or
substantially impair property values within the neighborhood.
