Board Member Bawden introduced the following resolution and moved for its adoption: RESOLUTION//97-12-333 RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO SETBACK REQUIREMENTS FOR ACCESSORY BUILDINGS HOUSING ANIMALS WHEREAS, Elmer and Judy Kuemper (Permittees) have properly applied for a variance from Sections 5.09.04 and 9.20.11 of the Ramsey City Code to construct an accessory building that will house animals nearer a property line and residence than is allowed on the property generally known as 5420 151 st Avenue NW and legally described as follows: That part of the Southwest Quarter of Section 24, Township 32, Range 25, in Anoka County, Minnesota, described as follows: Commen.cing at a point on the centerline of State Trunk Highway No. 47 as it is now laid out and traveled, said point being 93 feet Southeasterly, as measured along said centerline from the Northeasterly extension of the Southeasterly line of Block 3 in Gorham's Addition; thence South 64 degrees 18 minutes West on a line parallel to the Southeasterly line of said Block 3 a distance of 340 feet to the point of beginning of land to be described; thence continue South 64 degrees 18 minutes West on same described line a distance of 36.78 feet; thence Southeasterly on a curve to the left having a radius of 103.25 feet a distance of 113.96 feet; thence South 1 degree 03 minutes 40 seconds West a distance of 345.42 feet; thence Southwesterly on a curve t° the right having a radius of 115.75 feet a distance of 121.49 feet, thence South 61 degrees 11 minutes 55 seconds West a distance of 286.99 feet; thence North 1 degree 03 minutes 40 seconds East a distance of 534.42 feet to a point which is 160 feet Southeasterly of, as measured at right angles to, the Southwesterly extension of the Northwesterly line of said Block 3; thence North 64 degrees, 18 minutes East on a line parallel to the Southwesterly extension of the Northwesterly line of said Block 3 a distance of 57.52 feet; thence North 11 degrees 39 minutes 50 seconds West a distance of 164.92 feet to a point on the Southwesterly extension of the Northwesterly line of said Block 3; thence Northeasterly on said Southwesterly extension a distance of 330 feet to a point which is 110 feet Southwesterly of the Northwest comer of Said Block 3 said distance being measured along the Southwesterly extension of the Northwesterly line of said Block 3; thence Southeasterly at right angles a distance of 160 feet; thence continuing Southeasterly a distance of 33 feet to the point of beginning, along the last described line. (the" S ubj ect Property") AND WHEREAS, the Board of Adjustment conducted a public hearing on December 2, 1997, pursuant to Section 9.03.05 of the Ramsey City Code. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That based on Findings of Fact # 0449, a variance to construct an accessory building that will house animals within 10 feet of a side property line and 75 feet a property line is hereby granted.
