Councilmember Haas Steffen introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #98-03-041 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO OPERATE A TWO FAMILY DWELLING UNIT IN THE R-1 RURAL <br />RESIDENTIAL DISTRICT <br /> <br /> WHEREAS, Scott and Gwyn Simpson have properly applied for a conditional use permit <br />("Permit") to operate a dwelling in the single family district as a two unit rental building on the <br />property generally known as 16001 Nowthen Blvd. N.W. and legally described as follows: <br /> <br />That part of the east 100 feet of the Northeast Quarter of the Southeast Quarter of Section <br />15, Township 32, Range 25, Anoka County, Minnesota lying northeasterly of the County <br />State Aid Highway Number 5 (also known as Nowthen Boulevard. <br /> <br /> WHEREAS, the Planning Commission met on February 3, 1998, conducted the public <br />heating and recommended City Council denial of the request based on the findings of fact <br />proposed; and <br /> <br />WHEREAS, the City Council reviewed the facts and amended the findings of fact. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #0450, a conditional use permit (the "Permit") for a two family <br />rental unit within the single family district is hereby granted to Scott and Gwyn Simpson, <br />(the "Permit Holder"), at 16001 Nowthen Blvd. N.W. (the "Subject Property"). <br /> <br />2. That said Permit shall remain in effect so long as the conditions imposed herein are complied <br /> <br />3. That the structure exterior shall not be further altered to promote the appearance of a two unit <br /> structure. <br /> <br />4. That the structure shall not be further altered to render it marketable as a condominium. <br /> <br />That there shall be no more than 2 family units occupying the structure at any given time. <br />For purposes of this Permit, a family unit shall be defined as follows: an individual or two <br />(2) or more persons related by blood, marriage or adoption, or a group of not more than five <br />(5) persons (excluding servants) who need not be related by blood, marriage or adoption <br />living together in a dwelling unit. <br /> <br /> <br />
