Councilmember Zimmerman introduced the following resolution and moved for its adoption: RESOLUTION #98-04-069 RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR STREET, DRAINAGE AND UTILITY PURPOSES WHEREAS, the City as a part of Improvement Project 94-20 has installed sanitary sewer lines over, under and across Outlot B, GATEWAY NORTH INDUSTRIAL PARK ("Outlot B"); and WHEREAS, the City some time in the future intends to extend McKinley Street west to its intersection with Jasper Street over and across Outlot B; and WHEREAS, the City intends to extend its watermains to service the AEC Energy Park over, under and across Outlot B; and WHEREAS, the City has authority to acquire real property for Public Improvements by eminent domain pursuant to Minn. Stat. Chapter 117; and WHEREAS, the City has the right to acquire the real property prior to the filing of an award by the court appointed commissioners, pursuant to Minn. Stats. § 117.011 and § 117.042; and WHEREAS, the real property which needs to be acquired for the sanitary sewer, water and street purposes described above is legally described as follows: Outlot B, GATEWAY NORTH INDUSTRIAL PARK, Anoka County, Minnesota; That part of Lot 1, Block 1, BURY & CARLSON ADDITION, Anoka County, Minnesota, described as follows: Beginning at the most northerly comer of said Outlot B; thence North 70 degrees 38 minutes 07 seconds East, assumed bearing, along the northeasterly extension of the northerly line of said Outlot B a distance of 14.08 feet; thence south 25 degrees 28 minutes 32 seconds East a distance of 359.05 feet; thence southeasterly along a tangential curve concave to the northeast having a radius of 550.00 feet; a central angle of 41 degrees 13 minutes 12 seconds, a distance of 395.68 feet; thence South 66 degrees 41 minutes 44 seconds East a distance of 247.02 feet to the east line of said Lot 1; thence southerly along the east line of said Lot 1 to its intersection with the northeasterly line of said Outlot B; thence northwesterly along said northeasterly line to the point of beginning.
