and which parcels are identified as Anoka County PIN: 27-32-25-34-0005 and PIN: 27-32-25- <br />33-0009; and <br /> <br /> WHEREAS, the property owner of the real property which needs to be acquired has been <br />identified by the City as follows: <br /> <br />Bury & Carlson, Inc., a Minnesota Corporation <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the City Administrator is hereby directed to acquire the real property as described above <br />in accordance with Minnesota Statutes. The City Administrator is authorized to negotiate <br />and represent the City of Ramsey in all proceedings. <br /> <br />2. That if the real property as described above cannot be acquired by direct negotiation, it shall <br /> be acquired by eminent domain. <br /> <br />That the City Council hereby authorizes acquisition of the said real property by eminent <br />domain and to take title and possession of that land prior to filing of an award by the Court <br />Appointed Commissioners pursuant to Minnesota Statutes § 117.011 and § 117.042. <br /> <br />That the City Attorney is authorized to file the necessary petition therefore, and to prosecute <br />such action to a successful conclusion or until it is abandoned, dismissed or terminated by the <br />City of Court. <br /> <br />5. That the City Administrator is authorized to expend necessary funds for appraisals of above <br /> described real property. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Beahen and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gamec <br />Councilmember Zimmerman <br />Councilmember Beahen <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />RESOLUTION #98-04-069 <br /> Page 2 of 3 <br /> <br /> <br />
