The Subject Property is eligible for building permits for one dwelling unit and related <br />accessory structures in accordance with City Code and no further building permits for <br />additional residential structures will be issued until such time as the Subject Property is <br />replatted in accordance with City Code and access is provided via a public road improved to <br />City standards. <br /> <br />4. The Permittees shall obtain all necessary permits prior to commencing any construction, <br /> including a permit from Anoka County for access onto County Road No. 63. <br /> <br />The Permittees shall make a reasonable effort to locate the residential structure and any <br />accessory buildings constructed on the Subject Property so as not to interfere with the <br />orderly resubdivision of the Subject Property at some point in the future, and by accepting <br />this variance acknowledge that not doing so may adversely impact the ability of the Subject <br />property to be subdivided in the future. <br /> <br />o <br /> <br />The Permittees shall be responsible for maintaining the driveway in a manner that will <br />facilitate access by emergency vehicles, and this shall include a minimum of a 12 foot wide <br />Class 5 surface and maintaining a tree and vegetation clearance of at least 5 feet on either <br />side of the driveway. <br /> <br />The Permittee agrees that this variance shall be recorded in the office of the Anoka County <br />Recorder and agrees that the terms and provisions of this variance shall run with the land and <br />shall bind the property owner and his/her successor and assigns. <br /> <br />8. The Permittee shall be responsible for all City costs incurred in administering and enforcing <br /> this variance. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Bawden, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Deemer <br />Board Member Anderson <br />Board Member Bawden <br />Board Member LaDue <br />Board Member Terry <br />Board Member Wivoda <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />NODe <br /> <br /> <br />
