Councilmember Beahen introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #98-07-163 <br /> <br />RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT #0464 AND DECLARING TERMS OF PERMIT TO <br />GRADE AND EXPORT SOILS <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution No. 98-07-162 adopting <br />Findings of Fact #464 for this use and herein approves the Conditional Use Permit subject to the <br />following conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On July 28, 1998 a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") <br />to Michael LeBlanc ("Permit Holder") for grading operations on the property legally described as <br />follows: <br /> <br />Lots 1, 2 and 3, Block 1, PINEVIEW ESTATES 2ND ADDITION, ANOKA COUNTY, <br />MINNESOTA <br />("Subject Property:") <br /> <br />This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br />conditions of this permit are as follows: <br /> <br />This permit shall expire three (3) years from the date of commencement of operations and <br />the Permit Holder shall be responsible for providing the City with at least 48 hours advance <br />notice of the date of commencement of operations. <br /> <br />The ingress and egress to the Subject Property shall be from the southwestem comer of the <br />site, due south for a distance of approximately 700 feet, then due eastward using a gravel <br />road (constructed by the City for access to Well Nos. 3 and 4) for a distance of ½ mile. <br />Access from the public road system shall be at the intersection of C.R. gl 16 and C.R. #56. <br />The Permit Holder shall provide a 75 foot long gravel approach at the access point onto <br />Ramsey Blvd. to minimize the tracking of grading materials from the site onto the public <br />highway. The Permit Holder shall be responsible for obtaining and complying with any <br />permits deemed necessary from Anoka County. In addition, the Permit Holder shall be <br />responsible for immediately removing any spilled material from the public roads or the <br />City well road upon direction to do so by the City Engineer. Failure to do so shall be cause <br />for the City Engineer to order the necessary work to be done and billed to the Permit <br />Holder. <br /> <br /> <br />
