o <br /> <br />o <br /> <br />10. <br /> <br />All grading operations shall be conducted in accordance with the one (1) sheet plan <br />submitted by the Applicant in conjunction with the application. The proposed area to be <br />graded is approximately five (5) acres in size. Grading shall require finished grade areas to <br />be restored with six (6) inches of topsoil, seed and disc anchored mulch. <br /> <br />All equipment used for grading and hauling operations shall be maintained and operated in <br />such a manner to minimize noise, dust, and vibrations adversely affecting surrounding <br />properties. All equipment shall be kept in good repair. Failed equipment and rubbish shall <br />be removed from the work site regularly. <br /> <br />Except for the Permit Holder's personal equipment and property, only equipment required <br />for the excavation, grading and hauling of materials shall be allowed onto the site. <br />Equipment associated with the processing of the excavated materials such as crushers, <br />washers, conveyors, etc., are prohibited. <br /> <br />All work sites shall be properly safeguarded to prevent the general public from depositing <br />garbage or other refuse on the work site. <br /> <br />Prior to the removal of trees, the City Engineer shall be notified at least 72 hours in <br />advance of the removal so that the number of trees required for reforestation can be <br />determined. <br /> <br />Grading operations shall be conducted in such a manner to minimize interference with the <br />surface water drainage outside the boundaries of the operation. <br /> <br />Fencing may be ordered by the City Council or City Engineer anytime the permit is in <br />force and shall be installed within 24 hours of written notice. <br /> <br />All haul roads to and from the Subject Property shall be maintained in order to minimize <br />dust and in a condition satisfactory to the City Engineer. This work shall include <br />application of water, bituminous material, or calcium chloride to the road surface as may <br />be necessary to alleviate dust nuisance and eliminate traffic hazards. This work shall also <br />include daily inspections of Ramsey Boulevard and C.R. #116, and the removal of spillage <br />of any materials from the operation. When hauling operations are completed, the permit <br />holder shall either restore that haul road to a condition at least equal to that which existed <br />at the time the hauling operations were started, or compensate the local road authority in an <br />amount satisfactory to that road authority and concurred in by the City Engineer for the <br />restoration of that haul road. The City Engineer will then accept such restoration or concur <br />in such financial settlement for the restoration of the haul road in writing and such <br />acceptance will relieve the permit holder of any additional obligation in connection with <br />the restoration of the haul roads. If the permit holder fails or refuses to perform haul road <br />restoration or to make satisfactory financial settlement for such restoration, the City will <br />cause the restoration work to be done and require reimbursement from the financial <br />guarantee required herein. <br /> <br />RESOLUTION #98-07-163 <br /> Page 2 of 6 <br /> <br /> <br />
