9) That no blasting will be employed in the grading activity at either site. <br /> 10) That the existing drainage patterns will not be substantially altered by the proposed grading <br /> plans. <br /> 11) That the grading plan does not propose the use of silt fence, but the City will require it on <br /> at least Site A. <br /> 12) That the grading operation will increase the traffic to and from the subject property for a <br /> period of time the permit is in effect. <br /> 13) That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br /> residing or working in the vicinity of the use or to the public welfare. <br /> 14) That the proposed use will not substantially adversely impair the use, enjoyment, or market <br /> value of any surrounding property. <br /> 15) That the proposed use will not be hazardous to existing or future neighboring uses. <br /> 16) That the proposed use will not be disturbing or existing neighboring uses during the term <br /> of the permit. <br /> 17) That the proposed use will be served adequately by public facilities and services such as <br /> highways and streets. <br /> 18) That the proposed use will not create excessive additional requirement at public cost for <br /> public facilities and services, and it will not be detrimental to the economic welfare of the <br /> community. <br /> 19) that the proposed activities, processes, materials, and equipment and conditions of <br /> operation that may be detrimental to any persons,property, or the general welfare by reason <br /> of excessive production of traffic, noise, smoke, fumes, glare, or orders are controlled by <br /> City Code and should the permit be granted, these private rights will be protected by the <br /> contract entered into with the City. <br /> The motion for the adoption of the foregoing findings of fact was duly seconded by <br /> Councilmember Zimmerman, and upon vote being taken thereon, the following voted in favor <br /> thereof: <br /> Mayor Gamec <br /> Councilmember Beahen <br /> Councilmember Zimmerman <br /> and the following voted against the same: <br /> None <br /> Resolution #98-07-164 <br /> Page 2 of 3 <br />
