Couneilmember Haas Steffen introduced the following resolution and moved for its adoption: <br /> RESOLUTION//98-08-207 <br /> <br />RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT #0468 AND DECLARING TERMS OF PERMIT TO <br />GRADE SOILS <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution No. 98-08-206 adopting <br />Findings of Fact #0468 for this use and herein approves the Conditional Use Permit subject to <br />the following conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On August 25, 1998 a Conditional Use Permit ("CUP") was issued by the City of Ramsey <br />("City") to Ronald J. Kabat ("Permittee") for grading operations on the property legally described <br />as follows: <br /> <br />Lot 4, Block 5, Fox Ridge Estates 2nd Addition, ANOKA COUNTY, MINNESOTA <br />("Subject Property:") <br /> <br />This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br />conditions of this permit are as follows: <br /> <br />This permit shall expire three (3) years from the date of commencement of operations and <br />the Permit Holder shall be responsible for providing the City with at least 48 hours advance <br />notice of the date of commencement of operations. <br /> <br />The Permit Holder shall be responsible for immediately removing any spilled material from <br />the public roads upon direction to do so by the City Engineer. Failure to do so shall be cause <br />for the City Engineer to order the necessary work to be done and billed to the Permit Holder. <br /> <br />All grading operations shall be conducted in accordance with the three (3) sheet plan <br />submitted by the Permittee in conjunction with the application and dated received by the <br />City on July 15, 1998. Grading shall require finished grade areas to be restored with six (6) <br />inches of topsoil, seed and disc anchored mulch. <br /> <br />All equipment used for grading operations shall be maintained and operated in such a <br />manner to minimize noise, dust, and vibrations adversely affecting surrounding properties. <br />All equipment shall be kept in good repair.
