14. There shall be no stockpiling of graded materials, other than the topsoil on a temporary <br /> basis, allowed within the boundaries of the Subject Property. <br /> <br />15. The Permittee shall file with the City a liability insurance policy or certificate of such <br /> insurance acceptable to the City and issued by an insurance company authorized to do <br /> business in the State of Minnesota. <br /> <br />16. The policy shall insure the permit holder for the sum of at least $300,000 for injury to one <br /> person and $500,000 for one accident, and at least $1,100,000 property damage. <br /> <br />17. Said policy shall be for the full period of the permit and shall provide for the giving of 10 <br /> days prior notice to the City by registered mail of termination, cancellation or amendment of <br /> the policy. <br /> <br />18. In the event said policy is terminated for any reason, the permit shall be automatically <br /> suspended upon the day the policy terminates unless a new policy complying with this item <br /> is obtained and filed with the City prior to the termination of the policy in force. <br /> <br />19. The maximum noise level at the perimeter of the work site shall be within the limits set by <br /> the Minnesota Pollution Control Agency and the Environmental Protection Agency of the <br /> United States. <br /> <br />20. All costs incurred by the City in executing and administering this permit shall be the <br /> responsibility of the permit holder. The permit holder shall maintain a minimum Five <br /> Hundred Dollar ($500.00) balance in an escrow account with the City. This escrow shall be <br /> used to reimburse the City for expenses incurred in the administration of this permit. At the <br /> time the mining operation and site restoration are completed to the satisfaction of the City, <br /> the balance of the escrow shall be returned to the Permit Holder. <br /> <br />21. All grading operations shall be conducted between 7:00 a.m. and 8:00 p.m. on weekdays <br /> only unless otherwise specifically approved by the City Administrator and/or his designee. <br /> <br />22. The amount of dust or other particulate matter caused by the mining operation shall not <br /> exceed the standards established by the Minnesota Pollution Control Agency. No operation <br /> shall be allowed when wind gust exceed 30 miles per hour. <br /> <br />23. All operations shall comply with all applicable Minnesota Pollution Control Agency <br /> regulations and Federal and Environmental Protection Agency regulations for the protection <br /> of water quality. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Beyer and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />RESOLUTION #98-08-207 <br /> Page 3 of 5 <br /> <br /> <br />
