Commencing at Point B heretofore mentioned; then north and parallel <br />with the West Line of said Southwest Quarter of the Northwest Quarter for a distance of <br />496.01 feet; then northerly in a straight line to a point on the North Line of said <br />Southwest Quarter of the Northwest Quarter a distance of 1100 feet east from the <br />northwest corner of said Southwest Quarter of the Northwest Quarter and there <br />terminating. <br /> <br />(the "Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That on July 7, 1998, Mark and Doni Heule, hereinafter referred to as "Applicants", properly <br />applied for a conditional use permit for a private dog kennel to maintain more than two adult <br />dogs on the Subject Property. <br /> <br />That the applicants appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on July 7, 1998, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br /> <br />3. That the Subject Property and surrounding parcels are zoned R-1 Rural Residential. <br /> <br />4. That the Subject Property is approximately 3.9 acres in size. <br /> <br />5. That Section 9.02 of the Ramsey City Code defines dog kennel as any place where three or <br /> more dogs over three months of age are kept. <br /> <br />6. That Section 9.20.11 (R-1 Rural Residential District) does not establish dog kennels as a <br /> permitted use of property in this District. <br /> <br />That the Applicants stated that they were unaware of the restriction on the number of dogs <br />that may be kept on a parcel without a special permit and have been maintaining eight (8) <br />show dogs at the Subject Property for the past 7 years. <br /> <br />That the Applicants have submitted a letter which explains that they raise show dogs, <br />currently eight (8) Belgian Tervurens, that reside in the home and no more than three (3) <br />dogs at a time are allowed outdoors in a fenced two acre exercise area, and no dogs are <br />allowed outdoors unless at least one of the Applicants is home. <br /> <br />That the Applicant's application also states that generally two (2) of the eight show dogs <br />reside with a handler in Texas, so at any given time there are usually six (6) dogs being kept <br />on the Subject Property and most have been surgically debarked. <br /> <br /> <br />
