Councilmember Beyer introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #98-10-261 <br /> <br />RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT #0477 AND DECLARING TERMS OF PERMIT TO <br />GRADE AND EXPORT SOILS <br /> <br /> WHEREAS, the Ramsey City Cotmcil adopted Resolution No. 98-10-260 adopting <br />Findings of Fact #0477 for this use and herein approves the Conditional Use Permit subject to <br />the following conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On October 27, 1998, a Conditional Use Permit ("CLIP") is hereby issued to the City of Ramsey <br />("Permittee") for grading operations on the property legally described as follows: <br /> <br />That part of the Northeast Quarter of the Southwest Quarter of Section 25, Township 32, <br />Range 25, Anoka County, Minnesota, lying southwesterly of the southwesterly right-of- <br />way line of County State Highway No. 5 and lying easterly of the easterly right-of-way <br />line of Dysprosium Street and lying westerly of the westerly right-of-way line of Trunk <br />Highway No. 47, subject to easements of record. <br /> <br />("Subject Property") <br /> <br />This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br />conditions of this permit are as follows: <br /> <br />1. This permit shall expire three (3) years from the date of commencement of operations. <br /> <br />The ingress and egress to the Subject Property shall be from Dysprosium Street and <br />County Road #5 (Nowthen Blvd. N.W.). The Permittee shall provide a 75 foot long <br />gravel approach at the access point onto Dysprosium Street N.W. to minimize the <br />tracking of grading materials from the site onto the public highway. The Permittee or the <br />Permittee's designee shall be responsible for obtaining and complying with any permits <br />deemed necessary from Anoka County. In addition, the Permittee shall be responsible for <br />removing any spilled material from the public roads immediately upon direction to do so <br />by the City Engineer. <br /> <br />All grading operations shall be conducted in accordance with the one (1) sheet plan <br />submitted by the Dunbar Development and Miller Hanson Westerbeck Berger, Inc., in <br />conjunction with the senior housing project, labeled as C-1 Grading, Drainage & Erosion <br />Control Plan and dated 9/25/98. The proposed area to be graded is approximately 3.6 <br />acres in size. <br /> <br /> <br />
