o <br /> <br />o <br /> <br />o <br /> <br />10. <br /> <br />11. <br /> <br />All equipment used for grading and hauling operations shall be maintained and operated <br />in such a manner to minimize noise, dust, and vibrations adversely affecting surrounding <br />properties. All equipment shall be kept in good repair. Failed equipment and rubbish <br />shall be removed from the work site regularly. <br /> <br />All work sites shall be properly safeguarded to prevent the general public from depositing <br />garbage or other refuse on the work site. <br /> <br />Grading operations shall be conducted in such a manner to minimize interference with the <br />surface water drainage outside the boundaries of the operation. <br /> <br />Fencing may be ordered by the City Council or City Engineer anytime the permit is in <br />force and shall be installed within 24 hours of written notice. <br /> <br />All haul roads to and from the Subject Property shall be maintained in order to minimize <br />dust and in a condition satisfactory to the City Engineer. This work shall include <br />application of water, bituminous material, or calcium chloride to the road surface as may <br />be necessary to alleviate dust nuisance and eliminate traffic hazards. This work shall also <br />include daily inspections of Dysprosium Street N.W. and County Road #5 and the <br />removal of spillage of any materials from the operation. When hauling operations are <br />completed, the permittee shall either restore that haul road to a condition at least equal to <br />that which existed at the time the hauling operations were started, or compensate the local <br />road authority in an amount satisfactory to that road authority and concurred in by the <br />City Engineer for the restoration of that haul road. The City Engineer will then accept <br />such restoration or concur in such financial settlement for the restoration of the haul road <br />in writing and such acceptance will relieve the permit holder of any additional obligation <br />in connection with the restoration of the haul roads. If the permit holder fails or refuses <br />to perform haul road restoration or to make satisfactory financial settlement for such <br />restoration, the City will cause the restoration work to be done and require reimbursement <br />from the financial guarantee required herein. <br /> <br />The maximum slope other than the working face shall be sloped on all sides no steeper <br />than a rate of 2 foot horizontal to 1 foot vertical. In no case shall the slope of the working <br />face be left unattended with a slope greater than 2 feet horizontal to 1 foot vertical. When <br />mining operations are anticipated to be discontinued for an interval greater than two <br />working days, the slopes shall be flattened to a grade no steeper than 4 feet horizontal to 1 <br />foot vertical. Final slopes shall be consistent with the plan submitted and shall be no <br />steeper than 12 feet horizontal to 1 foot vertical. <br /> <br />Ingress and egress shall be from Dysprosium Street N.W. via County Road #5. Public <br />haul roads beyond the Subject Property and Dysprosium Street shall be limited to State <br />and County roadways. <br /> <br />Prior to commencing any grading operations, a cash escrow or letter of credit approved as <br />to form by the City in the amount of Ten Thousand Dollars and no cents ($10,000.00) <br />shall be deposited with the City.
