Councilmember Beyer introduced the following resolution and moved for its adoption: RESOLUTION//98-11-283 A RESOLUTION ADOPTING FINDING OF FACT #0480 RELATING TO A REQUEST FROM SCOTT LEBAKKEN FOR A CONDITIONAL USE PERMIT TO EXCEED THE MAXIMUM SINGLE ACCESSORY STRUCTURE SIZE ALLOWED ON PARCELS 1 ACRE OR LESS IN SIZE. WHEREAS, the City of Ramsey received an application from Scott Lebakken for a conditional use permit to exceed the maximum single accessory structure size allowed on the property generally known as 14100 Germanium Street N.W. and legally described as follows: Lot 4, Block 1, Flintwood Hills, Anoka County, Minnesota. (the "Subject Property"). NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: That on October 20, 1998, Scott Lebakken, hereinafter referred to as "Applicant", properly applied for a conditional use permit to exceed the maximum single accessory structure size allowed on parcels one acre or less in size. That the Applicants appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.04 of the City Code on November 2, 1998, and that said public hearing was properly advertised and that the minutes of said public heating are hereby incorporated as a part of these findings by reference. 3. That the Subject Property and surrounding parcels are zoned R-1 Rural Residential. 4. That the Subject Property is approximately .9 acres in size That Section 9.11.02 of the Ramsey City Code states that on parcels 1 acre or less in size, the total of attached and detached garages or accessory buildings shall not exceed 1,488 square feet, however, no single accessory structure shall exceed 624 square feet in size. 6. That the Applicant currently has a 528 square foot attached garage and is proposing to construct an additional 960 square foot garage, for a total of 1,488 square feet. That the total square footage for the existing and proposed garage is within the total allowable garage space on the Subject Property, however the proposed garage exceeds the maximum single building size by 336 square feet.
