Councilmember Haas Steffen moved for the adoption of the following findings of fact: <br /> <br />RESOLUTION #99-02-035 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0486 RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR A CELLULAR TELEPHONE <br />BASE STATION <br /> <br /> WHEREAS, AirTouch Communications, Inc., hereinafter referred to as "Applicant", has <br />properly applied for a Conditional Use Permit to construct, install and operate a cellular <br />telephone base station ("Tower") on the property generally known as 9539 Hwy. #10 NW and <br />legally described as follows: <br /> <br />Lot 1, Block 1, COWLES ADDITION, Anoka County, <br />(the "Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the Ramsey City Code on January 5, 1999, and that said <br />public hearing was properly advertised and that the minutes of said public heating are <br />hereby incorporated by reference. <br /> <br />That the Subject Property is located in the B-1 Business District, is approximately 2.2 <br />acres in size, and is owned by Frank Moody. <br /> <br />That the Applicant is proposing to lease a 26' x 52' section of the Subject Property (Site) <br />to facilitate the development and operation of the Tower. <br /> <br />That the property to the north is occupied by the Burlington Northem railroad, the parcels <br />to the east and west are also zoned B-1 Business, and the Subject Property is bounded by <br />Hwy. # 10 on the south. <br /> <br />5. That City Code restricts tower heights in the commercial districts to 165 feet. <br /> <br />That the Applicant is proposing to construct a 159 foot self-supporting tower (165 feet <br />including antennas) with a 12' x 24' x 10'7" equipment building at the base of the tower. <br /> <br />That the City Code establishes a setback for towers and related equipment buildings in <br />accordance with the established setbacks for the underlying zoning district, which in this <br />case is 35 feet rear yard and 10 feet side yard. <br /> <br />That the proposed location for the Tower and equipment building on the plan revision <br />dated January 5, 1999 meets the B-1 Business District setback standards. <br /> <br />That City Code requires ground mounted equipment to be screened from view by suitable <br />vegetation, except where a design of non-vegetative screening better reflects and <br />complements the character of the surrounding neighborhood, as determined by City <br />Council <br /> <br /> <br />
