10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />18. <br /> <br />19. <br /> <br />20. <br /> <br />21. <br /> <br />22. <br /> <br />That the tower and equipment building are proposed to be constructed on an existing <br />paved parking lot where planting vegetative screening is not an option; however, there is <br />an existing tree line in the vicinity of the tower site that meets the screening requirement. <br /> <br />That the Applicant has submitted support documents to the application consisting of a 4- <br />page letter describing the proposal dated December 21, 1998 and authored by Jaymes D. <br />Littlejohn from the Applicant's legal representative Hessian & McKasy; and a Elevation <br />and Vicinity Map prepared by Minthelinks dated December 11, 1998, revision dated <br />January 5, 1999. <br /> <br />That the Applicant has stated that the tower will not cause any interference to any other <br />broadcast systems. <br /> <br />That the Applicant has stated that there will be no personnel stationed at the site and the <br />base of the tower will be encompassed by a security fence to prevent unauthorized entry. <br /> <br />That the Applicant has stated that the existing access to the Subject Property is adequate <br />and no parking will be required because site visits will be infrequent and of limited <br />duration. <br /> <br />That City Code states that no new tower shall be approved unless the City Council finds <br />that the equipment planned for the proposed tower cannot be accommodated on an <br />existing or approved tower or building within a ½ mile radius of the proposed tower for <br />various reasons including insufficient height to fimctional reasonably. <br /> <br />That the Applicant has stated that there are no existing buildings in the ½ mile search area <br />of a sufficient height to accommodate the proposed equipment. <br /> <br />That there are two existing towers located .3 miles and 2.06 miles from the proposed <br />Tower location that the Applicant states are not of a sufficient height to accommodate the <br />proposed equipment so that it will function reasonably. <br /> <br />That the City has engaged the services of a consultant to confirm that the existing tower in <br />the ½ mile search area is not of a sufficient height to meet the needs of the Applicant. <br /> <br />That the Applicant's submittal clearly states that the structure will be designed to <br />accommodate two additional users. <br /> <br />That the proposed use will not substantially impair the use or market value of surrounding <br />properties. <br /> <br />That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />working in the vicinity of the use, or to the public welfare. <br /> <br />That the proposed use will not be hazardous or disturbing to existing or future neighboring <br />uses. <br /> <br />RESOLUTION #99-02-035 <br /> Page 2 of 3 <br /> <br /> <br />
