WHEREAS, the Anoka County PIN's for the various parcels are as follows: <br /> 28-32-25-13-0001 <br /> 28-32-25-13-0005 <br /> 28-32-25-42-0001 <br /> 28-32-25-44-0010 <br /> 28-32-25-41-0001 <br /> and <br /> WHEREAS, the property owner of the Subject Property has been identified by the City <br /> as follows: <br /> B.M.A. ASSOCIATES, a Minnesota Partnership <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> 1. In order to carry out the purposes and objectives described above it is necessary to acquire <br /> the Subject Property. <br /> 2. The acquisition of the following Subject Property by exercise of eminent domain in the <br /> manner provided by Minnesota Statute Chapter 117 serves a public interest and is deemed <br /> to be necessary. <br /> 3. The City deems it necessary for the reasons set forth above to proceed without delay <br /> under Minn. Stat. §117.042 to pay to the owners or into court a sum of money to serve as <br /> compensation to the owners of the Subject Property, which amount shall be equal to <br /> Petitioner's approved appraisal of value as determined by the City. <br /> 4. That the City Administrator is hereby directed to acquire the Subject Property in <br /> accordance with Minnesota Statutes. The City Administrator is authorized to negotiate <br /> and represent the City of Ramsey in all proceedings. <br /> 5. That if the Subject Property cannot be acquired by direct negotiation, it shall be acquired <br /> by eminent domain. <br /> 6. That the City Council hereby authorizes acquisition of the Subject Property by eminent <br /> domain and to take title and possession of that land prior to filing of an award by the <br /> Court Appointed Commissioners pursuant to Minnesota Statutes §117.011 and §117.042. <br /> 7. That the City Attorney is authorized to file the necessary petition therefore, and to <br /> prosecute such action to a successful conclusion or until it is abandoned, dismissed or <br /> terminated by the City or Court. <br /> 3 <br />
