WHEREAS, the Subject Property described below is necessary for the Campus Site; and <br /> WHEREAS, the City finds that the industrial park referenced above and the Campus Site <br /> would be compatible uses for the Subject Property and each use would in fact enhance the other; <br /> and <br /> WHEREAS, the City finds that the siting of the Campus Site within the City would <br /> provide numerous employment opportunities for City residents as well as make available within <br /> the City significant educational opportunities; and <br /> WHEREAS, the Subject Property is adjacent to the Burlington Northern railroad tracks <br /> which are proposed to be used for the North Star light real public transportation system; and <br /> WHEREAS, the City has identified the Subject Property as an ideal site for a light rail <br /> transportation center; and <br /> WHEREAS, the City has authority to acquire real property for public purposes by <br /> eminent domain pursuant to Minn. Stat. Chapter 117 and pursuant to its City Charter; and <br /> WHEREAS, the City has the right to acquire the real property prior to the filing of an <br /> award by the Court appointed commissioners, pursuant to Minn. Stats. §117.011 and §117.042; <br /> and <br /> WHEREAS, the real property which needs to be acquired for the industrial park or <br /> Campus Site and light rail purposes described above is legally described as follows: <br /> Parcel A: <br /> The Southwest Quarter of the Northeast Quarter of Section 28, Township 32, Range 25, <br /> Anoka County, Minnesota except the North 150 feet thereof, and Lot 1, AUDITOR'S <br /> SUBDIVISION NUMBER 34, Anoka County, Minnesota. <br /> AND - <br /> Parcel B. <br /> The Northeast Quarter of the Southeast Quarter of Section 28, Township 32, Range 25, <br /> Anoka County, Minnesota, and the Southeast Quarter of the Northeast Quarter of Section <br /> 28, Township 32, Range 25, Anoka County, Minnesota, except the East 417 feet of the <br /> Southeast Quarter of the Northeast Quarter of said Section 28, as measured along the <br /> South line thereof, except the North 150 feet thereof. And excepting the North 150 feet <br /> of the Southeast Quarter of the Northeast Quarter of Section 28, Township 32, Range 25, <br /> Anoka County, Minnesota, AND Lot 8, AUDITOR'S SUBDIVISION NUMBER 34, <br /> Anoka County, Minnesota; and <br /> (The "Subject Property:); and <br /> 2 <br />
