Mayor Gamee introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #99-05-088 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A MUSIC FESTIVAL LICENSE <br /> <br /> WHEREAS, on April 14, 1999, the Diamonds Sports Bar & Grill, Inc. (Applicant) <br />properly applied for a Music Festival License on the property legally described as follows: <br /> <br />Lot 1 and Outlot A, Block 1, The Diamonds, Anoka County, Minnesota <br />(the "Site); and <br /> <br /> WHEREAS, the Applicant submitted all application materials in accordance with <br />Chapter 7 (Licensing and Permits), Section 7.07 (Music Festivals); and <br /> <br />WHEREAS, the application was acted upon by City Council on May 11, 1999. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />A Music Festival License is hereby issued to Diamonds Sports Bar and Grill, Inc. (Licensee) <br />at 7550 Hwy. #10 N.W. for August 14, 1999, from 2:00 p.m. to 9:30 p.m. However no <br />outdoor liquor sales shall be permitted after 9:00 p.m., and the definition of outdoor shall <br />include the facility patio. Outdoor liquor sales may resume on the patio only at 10:30 p.m. <br /> <br />2. Outdoor liquor sales shall conform to State liquor laws relative to perimeter fencing and <br /> declaration within the insurance policy. <br /> <br />3. This License shall not be considered effective until the Licensee has provided the following: <br /> <br />The Licensee shall reimburse all owners and occupants of property adjoining the Site <br />for any and all loss, injury or damages to such owners or occupants or to their property <br />caused by the Licensee, by the owner of the Site, or by any person attending or <br />participating in the Music Festival, which damage would not have occurred had the <br />Music Festival not been held. A bond shall be provided in favor of the City and all <br />persons to whom the Licensee and/or owners of the Site may be liable. Said bond shall <br />be prepared by a corporate bonding company authorized to do business within the State <br />of Minnesota and shall be in the amount of not less than $50,000.00 and which Bond <br />shall be approved as to form and content by the City. <br /> <br />bo <br /> <br />The Licensee shall provide a hold harmless agreement providing that the Licensee shall <br />defend, indemnify, save and hold the City harmless from and on account of any and all <br />claims against the City for injury or damage of any kind, upon or about the Site or <br />arising from or in connection with the Music Festival from any cause whatsoever. The <br />Licensee shall provide and maintain in full force and effect for a period of one year <br />from the date of the Music Festival, a policy of public liability and property damage <br />insurance, in a form satisfactory to the City, in the amount of $250,000 for injury to any <br /> <br /> <br />
