Councilmember Hendriksen introduced the following resolution and moved for its adoption: RESOLUTION #99-06-116 A RESOLUTION ADOPTING FINDING OF FACT/40497 RELATING TO A REQUEST FROM ROBERT AND RITA KNOLL FOR A CONDITIONAL USE PERMIT FOR A PRIVATE DOG KENNEL TO MAINTAIN MORE THAN TWO ADULTS DOGS ON A PARCEL OF PROPERTY. WHEREAS, the City of Ramsey received an application from Robert and Rita Knoll for a conditional use permit to maintain more than two adult dogs on the property generally known as 16405 Quartz Street N.W. and legally described as follows: Lot 2, Block 2, Fox Knoll, Anoka County, Minnesota (the "Subject Property"). NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: That on April 27, 1999, Robert and Rita Knoll, hereinafter referred to as "Applicants", properly applied for a conditional use permit for a private dog kennel to maintain more than two adult dogs on the Subject Property. That the applicants appeared before the Rarnsey Planning Commission for a public hearing pursuant to Section 9.03.04 of the City Code on June 1, 1999, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. 3. That the Subject Property and surrounding parcels are zoned R-1 Residential. 4. That the Subject Property is 16,851 square feet in size or approximately .4 acres. 5. That Section 9.02 of the Ramsey City Code defines dog kennel as any place where three or more dogs over three months of age are kept. 6. That Section 9.20.11 (R-1 Rural Residential District) does not establish dog kennels as a permitted use of property in this District. 7. That the Applicants are proposing to maintain four (4) adult dogs on the Subject Property. That the Applicants have stated that their hobby is dog sports and includes obedience and agility competition, conformation, flyball and tracking for Labrador Retrievers and other similar mid-size sporting dogs.
