Board Member Johnson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #99-09-168A <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0504 RELATING TO A <br />REQUEST FOR A VARIANCE TO THE REAR YARD SETBACK REQUIREMENTS IN <br />THE B-3 HIGHWAY BUSINESS DISTRICT <br /> <br /> WHEREAS, LNR Properties, hereinafter referred to as "Applicant", has properly applied <br />for a Board of Adjustment variance from the rear yard setback requirements established in <br />Section 9.20.23 (B-3 Highway Business District) of the Ramsey City Code on the property <br />generally known as 6111 Hwy. #10 N.W. and legally described as follows: <br /> <br />Lots 1, iA, and 2, Block 1, GUY ADDITION, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to <br />Section 9.03.05 of the Ramsey City Code on September 7, 1999 and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br /> <br />2. That the subject property is zoned B-3 Highway Business and is approximately 2 acres in <br /> size. <br /> <br />° <br /> <br />That the adjacent parcels to the east and west and on the south side of Hwy. #10 are also <br />zoned B-3 Highway Business; the property on the north side of the Burlington Northern <br />Railroad tracks is zoned Industrial. <br /> <br />4. That the Applicant is proposing to construct a multi-tenant retail building with self-service <br /> mini-storage units on the Subject Property. <br /> <br />5. That the required structure setbacks in the B-3 Highway Business District are 35 feet front, <br /> 10 feet side and 35 feet rear. <br /> <br />The proposed location of the main building meets the front and side yard setback <br />requirements but encroaches on the rear setback by seven feet at the northwest comer of the <br />main building and increasing to an encroachment of 14.5 feet at the northwest comer. <br /> <br />Resolution #99-09-168A <br />Page 1 of 3 <br /> <br /> <br />
