10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />That the Applicant has stated that preserving a 20 foot wide corridor along the front property <br />line (in addition to the requirement for a 20 foot wide required landscape area adjacent to <br />public roads) for a possible future service road has caused an undue hardship which results in <br />the building encroaching on the rear yard setback requirement. <br /> <br />That there are unique circumstances applying to the Subject Property that do not generally <br />apply to other properties in the B-3 Highway Business district due to the preservation of a 20 <br />foot corridor for a future service road. <br /> <br />That the special conditions causing the undue hardship do not result from the actions of the <br />Applicant. <br /> <br />That if granted, the variance will not grant the Applicant any special privilege that is denied <br />to other owners of lands, structures or buildings in the same district. <br /> <br />That if granted, the variance will not be materially detrimental to the purposes of the Ramsey <br />Zoning Chapter or other property in the B-3 Highway Business District. <br /> <br />That if granted, the variance will not substantially increase the congestion of public streets, or <br />increase the danger of fire, or endanger the public safety, or substantially impair property <br />values within the neighborhood. <br /> <br />That if the variance is denied, the Applicant will not be able to put the property to reasonable <br />use. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Nixt and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Chairperson Leo Anderson <br /> Board Member Robert Johnson <br /> Board Member Michael Nixt <br /> Board Member Chris Dempsey <br /> Board Member Sharon Jensen <br /> Board Member William Kociscak <br /> Board Member Joseph Wivoda <br /> <br />and the following voted against the same: <br /> <br /> None <br /> <br />and the following abstained: <br /> <br /> None <br /> <br />Resolution #99-09-168A <br />Page 2 of 3 <br /> <br /> <br />
