6. In accordance with City Code, access to the proposed dwelling site is proposed from 178th Lane <br /> N.W <br /> <br />7. That the variance requested is the minimum which would alleviate the hardship. <br /> <br />That there are unique circumstances applying to the Subject Property that do not generally apply <br />to other properties in the district; namely, that the street frontage at County Road #63 meets the <br />minimum lot width requirement but access to the proposed building site is obstructed by a <br />County ditch and the fact that City Code discourages access onto a County road when an <br />alternative access is possible. <br /> <br />9. That the unique circumstances do not result from the actions of the Applicant. <br /> <br />10. That such variance is not necessary for the preservation of a substantial property right similar to <br /> that possessed by other properties in the R-1 Rural Residential District, namely the ability to <br /> have at least one dwelling on a 20 acre parcel. <br /> <br />11. That if granted, the variance will not grant the Applicant any special privilege that is denied to <br /> other owners of lands, structures or buildings in the same district. <br /> <br />12. That if granted, the variance will not be materially detrimental to the purposes of the Ramsey <br /> Zoning Chapter or other property in the R- 1 Rural Residential District because the Applicant is <br /> proposing to locate the home on the Subject Property so as not to obstruct extension of public <br /> streets into the Subject Property when it is developed to its ultimate density. <br /> <br />13. That if granted, the variance will not substantially increase the congestion of public streets, or <br /> increase the danger of fire, or endanger the public safety, or substantially impair property values <br /> within the neighborhood. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Kociscak and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Leo Anderson <br />Board Member Robert Johnson <br />Board Member William Kociscak <br />Board Member Chris Dempsey <br />Board Member Sharon Jensen <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />Resolution/t99-10-188 <br />Page 2 of 3 <br /> <br /> <br />
