Councilmember Connolly introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #99-11-212 <br /> <br />A RESOLUTION ADOPTING FINDING OF FACT #0508 RELATING TO A REQUEST <br />FROM DENNIS AND BONITA COBEY FOR A CONDITIONAL USE PERMIT FOR A <br />PRIVATE DOG KENNEL TO MAINTAIN MORE THAN TWO ADULTS DOGS ON A <br />PARCEL OF PROPERTY. <br /> <br /> WHEREAS, the City of Ramsey received an application from Dennis and Bonita Cobey <br />for a conditional use permit to maintain more than two adult dogs on the property generally <br />known as 9340 Highway #10 N.W. and legally described as follows: <br /> <br />The East 132 Feet of Lot 6, Auditor Subdivision 33, of Anoka County, Minnesota <br /> <br />(the "Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That on October 18, 1999, Dennis and Bonita Cobey, hereinafter referred to as "Applicants", <br />properly applied for a conditional use permit for a private dog kennel to maintain more than <br />two adult dogs on the Subject Property. <br /> <br />That the applicants appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on November 8, 1999, and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br /> <br />3. That the Subject Property is zoned B-1 Business but is subject to R-1 Residential regulations <br /> as the principal use of the property is a dwelling. <br /> <br />That the adjacent property to the west and the property on the north side of Hwy. #10 is also <br />zoned B-1 Business; the property to the east is the State Wayside Park; and the Subject <br />Property is bounded on the south by the Mississippi River. <br /> <br />5. That the Subject Property is approximately 3.7 acres in size. <br /> <br />6. That Section 9.02 of the Ramsey City Code defines dog kennel as any place where three or <br /> more dogs over three months of age are kept. <br /> <br />7. That Sections 9.20.11 (R-1 Rural Residential District) and 9.20.21 (B-1 Business District) <br /> does not establish dog kennels as a permitted use of property in these Districts. <br /> <br />8. That the Applicants are proposing to maintain four (4) adult dogs on the Subject Property. <br /> <br /> <br />
