GOODRICH <br />MARCH 15, 1983 <br />IMPROVEMENT PROJECT 83-1 (155TH AND VARIOLITE) <br /> <br />The City Engineer has advised that there are 26 various parcels related to this <br />project over which permanent street, utility and drainage easements and/or <br />temporary construction easements are needed in order to proceed. By letters <br />dated March 4, 1983, I advised the affected landowners of the easement necessity <br />and included an offer for the easement and a small map showing the location of <br />the easement as it relates to their property. The City Engineer determined the <br />offers by using land values based on the appraisals we had done for l67th Avenue <br />last tear and by reviewing the City Assessor's market values of the various <br />properties affected. <br /> <br />I requested that the landowners contact me prior to March 15 with any questions <br />or with their response to our offer. Approximately 10 of the owners have <br />contacted me. Their questions generally concern whether or not the project will <br />be assessed to them and most of the people wanted to wait on any final decision <br />regarding the easement until after the Council's final decision is made <br />regarding the assessment question. In addition, some of the owners have <br />questioned whether or not we did observe the trees, fences and shrubs, etc. on <br />their property in making our offer. We will review all of the property in <br />question to make certain that these matters are taken into consideration so that <br />appropriate compensation or other arrangements can be made. <br /> <br />I would request that the Council consider adoption of the following motion: <br /> <br />To authorize the City Attorney to acquire by direct negotiation the <br />necessary easements required in Project 83-1 and, if he is unable to <br />acquire said easement by direct negotiation, he is authorized to commence <br />at his discretion eminent domain proceedings in order to acquire the <br />easements so that construction may proceed in 1983. <br /> <br />I will keep you advised of. this easement acquisition status. <br /> <br />wkg/cmh <br /> <br />;. <br />
