<br />RESOLUTION 87- <br /> <br />:HEREAS, :the City of Ham Lake currently iI:poses a 2-1/2 acre <br />:iniI:um lot size for single faI:ily residential develo~ent, and <br /> <br />{HEREAS, the ttain reason for the imposition of that lot size has <br />Jeen to complY with the desires of the Twin Cities Area <br />':etropolitan council to inhibit population growth in the City of <br />oem Lake, in favor of encouraging population growth in areas reore <br />:entral to the reetropolitan area, and <br /> <br />,HEREAS, in a recent ruling of the united States supreree Court, <br />:o-wit, the case of First Enalish Evanaelical Lutheran Church of <br />;lendale vs. County of Los Anceles, California, a significant new <br />:uling on the issue of I:unicipal liability for the temporary <br />:eprivation of usage of land has been ireposed, and <br /> <br />;HEREAS, the issue of this I:unicipal liability where artificially <br />_arge lot sizes are concerned will apparently not be capable of <br />-esolution until and unless a lawsuit asserting lower density <br />:evelopreent rights is brought and completed, and <br /> <br />;HEREAS, the City's liability during this period of time ttay <br />cncrease beyond the ability of the City to insure or pay damages, <br />:nd <br /> <br />':HEREAS, the it::position of the abnort::ally large lot sizes in the <br />:ity of Ham Lake has been t:aintained for the sole purpose of <br />,=co~reodating the desires of the Metropolitan Council for overall <br />:etrcpolitan planning purposes, <br /> <br />:CW,. THEREFORE, E E IT RESOLVED BY THE CI'!'Y COCNCIL OF THE CITY OF <br />~~M LAKE AS FOLLOWS: <br /> <br />That the Minnesota Legislature is hereby urged to adopt <br />.egislation which would in effect indemnify local units of <br />:ove~n~ent =0= any liability incurred as a result of the <br />:~ntinued ~intenance by those local units of gove~n~ent of land <br />~se or subdivision regulations at ~he request or direction of the <br />:e~=opolitan Council, or other gove=n~ental agencies or bodies <br />=li~~c, requiring such inde~nificaticn to incluce inGec~ification <br />"== =cney da=ages and le~al de=ense cos~s.
