<br />.. <br /> <br />AN ACT FOR A BILL <br /> <br />Relating to land use regulations, i~posing a duty of <br />inderenification upon certain units of govern~ent toward other <br />bodies of govern~ent; <br /> <br />Section <br /> <br />. <br />---------- <br /> <br />Definitions. <br /> <br />Subdivision 1. controllina Unit. A controlling Unit shall <br />~ean any body politic, govern~ental agency, board, or <br />coremission, having any powers of authority to review, <br />co~reent upon, control, or reake reco~~endatior~ toward the <br />actions of any other body politic, govern~ent agency, <br />coremission, or board. Such an entity reay be both a <br />Controlling unit or a Responding unit, in different <br />situations, but, for the purposes of this section, the <br />liability ireposed for inde~nification shall be lireited to <br />situations in which the Controlling Unit has exercised its <br />powers or authorities with respect to t~e Responding Unit. <br /> <br />Subdivision 2. ResDondinq Unit. A Responding unit shall <br />refer to any body politic, governreental agency, board, or <br />co~mission, which; in a given situation, is subject to the <br />authority and power of a Controlling Unit. <br /> <br />Subdivision 3. Inde~ification Recuired. In any situation <br />where a Controlling Unit, by order, directive, or request, <br />direct or indirect, shall have caused or induced a <br />Responding Unit to enact or reaintain land use regulation <br />ordinances, including but not limited to subdivision <br />regulations and zoning ordinances, the Controlling unit <br />shall inderenify the Responding Unit frore any losS or da~age <br />occasioned by the cooperation of the Responding Unit, which <br />~nde~ification shall specifically include the duty on the <br />part of the ContrOlling Unit to defend any lawsuits arising <br />frore such ordinances against the Responding Unit, and to pay <br />any da~ages which ~ay be assessed against suc~ Responding <br />Units. <br /> <br />M <br />
