<br />1. The asphalt plant will be permitted to operate from April 1 <br />through November 30 of each year. <br /> <br />2. Hours of operation shall be from 6:00 a.m. to 8:00 p.m., Monday <br />through Saturday. Any variance from these hours of operation <br />shall require prior special approval by the City Administrator or <br />his designated representative. The City Council shall be notified <br />of the temporary change in hours. <br /> <br />3. Noises emanating from the site and operation shall be in <br />compliance with and re3ulated by the State of Minnesota Pollution <br />Control Standards, Minnesota Regulations NPC, as amended. <br /> <br />4. The emission of odor from the operation shall be in compliance <br />with and regulated by the State of Minnesota Pollution Control <br />Standards, Minnesota Regulation APC 1-15, as amended. <br /> <br />5. The emission of smoke from the operation shall be in compliance <br />.with and regulated by the State of Minnesota Pollution Control <br />Standards, Minnesota Regulation APC 1-15. as amended. <br /> <br />6. The emission of dust, fly ash or other particulated matter shall <br />be in compliance with and regulated by the State of Minnesota <br />Pollution Control Standards, Minnesota Regulation APC 1-15, as <br />amended. <br /> <br />7. The asphalt operation shall be in accordance with the regulations <br />of the Minnesota Pollution Control Agency and Environmental <br />Protection Agency. <br /> <br />8. Any stockpiles of materials shall be limited to a maximum heights <br />of 35 feet and shall be located no closer than 20 feet to any <br />property boundary. <br /> <br />9. The eastern boundary of the site shall be buffered with berming <br />and trees. Theberming shall be at least 5 feet in height and the <br />trees shall be at least six feet in height and shall be <br />full-bodied specimen plants. The stockpiling area along the <br />railroad shall be buffered with berming. <br /> <br />10. Off-street employee parking shall be provided such that there is <br />at least one parking space for each employee on the maximum <br />working shift. <br /> <br />11. All haul roads on the sites shall be surfaced with bituminous or <br />concrete. No build up of materials shall be permitted on any haul <br />roads. There shall be no use of City streets which are not <br />blacktopped. <br /> <br />12. Commercial Asphalt Company shall provide a map detailing haul <br />roads and haul routes to County and State highways which shall be <br />approved by the City Administrator or his designated <br />representative. Hauling may vary from these roads and routes only <br />for a specific job and only with the prior approval of the City <br />Administrator or his designated representative. The City Council <br />shall be notified of the temporary deviation from the specified <br />haul routes. <br /> <br />- 3 - <br />
