<br />15 Minutes CASE Ill: <br /> <br />APPOINT COUNCILMEKBER TO FILL <br />VACANCY ON THE CITY COUNCIL <br />By: Dsve Hartley, City Administrator <br /> <br />Background: <br /> <br />Our City Charter requires that if a vacancy exists on a City Council where <br />there remains less than 365 days in the unexpired term, the City Council shall, <br />by majority vote, appoint a successor to serve for the remainder of said term. <br />In the case of a tie vote of the Council, the Kayor shall make the appointment <br />from the candidates involved in the tie vote. <br /> <br />As you know, the City Council has solicited letters from individuals who have <br />expressed an interest in serving on the City CounciL To this date the five <br />persons submitting letters are David T. Bawden, Sr., Willard J. Breu, James R. <br />Gilbertson, Kenneth R. Peterson, and Larry G. Smith. Further, the City Council <br />has projected that it will make a decision on August 23, 1988 regarding filling <br />this vacancy. (A copy of this case is being mailed to each of the five <br />applicants.) <br /> <br />To assist the Council in an orderly method of making this determination, the <br />suggestion is offered that a balloting process be followed whereby each <br />Councilmember would rank the candidates in order of preference. By using this <br />method it can be determined whether or not a tie vote exists and therefore <br />permitting the Council to follow the direction of the City Charter as it <br />applies to tie votes; <br /> <br />Recommendation: <br /> <br />Council Action: <br />Motion to: <br />Appoint <br />December 31, 1988. <br /> <br />to fill a vacancy on the City Council until <br /> <br />==SWEARING IN CEREMONY== <br /> <br />Review Checklist: <br /> <br />Administrator <br />Attorney <br />Engineer <br />Community Development Director <br /> <br />-L <br />-L <br /> <br />Chief of Police <br />Finance Officer <br />Public Works Superintendent <br />Other <br /> <br />48 <br />
