Landfill Inspection Reports For October 1983; B. <br />Landfill Lawsuit Issue): <br /> <br />a) Landfill Inspection Reports For The Month Of October 1983 - <br /> <br />I Council noted. <br /> <br />I <br /> <br />COUNCIL NEW BUSINESS <br /> <br />Case #2: Request To Subdivide By Metes And Bounds; Case Of Mr. Henry Birchem: <br /> <br />I <br /> <br />Mayor Gamec expressed concerned that maybe there should be an easement in case <br />l77th is extended. <br /> <br />I <br /> <br />Mr. Birchem and Mr. Raatikka replied that 177th would not be extended; that <br />there are low wetlands involved and Thorn Lake is in that vicinity. <br /> <br />I <br /> <br />Motion by Councilmember Van Wagner and seconded by Councilmember Schlueter to <br />adopt the findings of fact as they relate to Mr. Henry Birchem's request to <br />subdivide by metes and bounds. <br /> <br />I <br /> <br />Motion carried. <br />and Van Wagner. <br /> <br />Voting Yes: <br />Voting No: <br /> <br />Mayor Gamec, Councilmembers Reimann, Schlueter <br />None. Absent: Councilmember Sorteberg. <br /> <br />I <br /> <br />Motion by Councilmember Van Wagner to approve of Mr. Henry Bichem' s request to <br />subdivide by metes and bounds contingent upon Mr. Birchem's entering into <br />and completing the terms of the development agreement. <br /> <br />I <br /> <br />Motion failed for a lack of second. <br /> <br />I <br /> <br />Discussion ensued whether or not the proposed cul~de-sac that Mr. Birchem would <br />construct would have to be blacktop. <br /> <br />I <br /> <br />Mr. Birchem replied that he could not afford blacktop, it would have to be <br />course gravel. <br /> <br />I <br /> <br />Mayor Gamec stated that if the cul-de-sac were to meet City standards, the <br />City would assume the responsibility of maintenance of that cul-de-sac. <br /> <br />I <br /> <br />Mr. Birchem replied that he has been assessed for improvements to 177th and <br />that road ends at the point of his property line. <br /> <br />Mr. Raatikka stated that Council could grant a variance to the blacktcop <br />requirement. <br /> <br />I <br /> <br />Councilmember Reimann stated that if Council grants a variance to subdivided <br />by metes and bounds, Mr. Birchem should blacktop the cul-de-sac.
