Motion failed for lack of a second. <br />Motion by Omedssioner Hendriksen and seconded by Oommissioner Deemer to amend <br />Item #5.d in the findings of fact in the case of Mr. Donald Ness to read as <br />follows "'i'hat there are currently no other approved similar uses in the City <br />of Ramsey". <br />Motion carried. Voting Yes: Chairman Peterson, Oommissioners Deemer, Shumway, <br />Zimmerman and Hendriksen. Voting No: None. Absent: Commissioner LaDue. <br />Motion by Conmmissioner Zim irerman and seconded by Commissioner Shumway to adopt <br />proposed findings of fact, as amended, for Mr. Donald Ness' request for a <br />conditional use permit. <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Deemer, Shunway, <br />Zimmerman and Hendriksen. Voting No: None. Absent: Commissioner LaDue. <br />Ooamission consensus is to amend the conditional use permit agreement in the <br />following ways: <br />1. Change the title 'Conditional Use Permit Agreement' to 'Special Use <br />Permit Agreement - Home Occupation'. <br />2. Change Item #4 in the agreement to specify 'Special Use Permit'. <br />3. Add the following item to the agreement: 1 5. 4here will be no <br />outside storage of materials and equipment.' <br />Motion by Commissioner Deemer and seconded by Commissioner Shunway to recommend <br />approval of the request by Mr. Donald Ness for a special use permit to operate <br />a hone occupation from his residence at 7735 156th Avenue N.W. contingent upon <br />the applicant entering into a special use permit agreement, as amended, with <br />the City. <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Deemer, Shunway, <br />Zimmerman and Hendriksen. Voting No: None. Absent: Commissioner LaDue. <br />Commission consensus is that they would be agreeable to granting variances to <br />minimum lot width as it would be consistent with other lots in the area and if <br />Mr. Zimmer can meet State building code requirements regarding garage floor <br />being 15" above street elevation. 4he Oommission stated that a survey would be <br />beneficial in determining the amount of fill needed in the new lot in order to <br />make it buildable and in that case, Mr. Zimmer might as well proceed with a <br />convenience plat rather than metes and bounds subdivision. <br />Mr. Carson was present regarding the lot split of property located at Industry <br />Avenue and Magnesium Street. <br />August 12, 1985 <br />Page 4of5 <br />
