ESCROW AGREEMENT <br />THIS AGREEMENT, made this _ L_ 4 day of �; 1964: <br />t WHEREAS, A & M Building Supply, Inc. (hereafter builder) has entered into <br />a construction contract with Thomas G. Landowski and Gregory G. Landowski (here- <br />after "owners ") for the construction of a steel warehouse /retail /office building <br />' upon Lot 1, Block 2, Alpaca Estate, Anoka County, Minnesota; and <br />WHEREAS, said building is substantially complete with the exceptions here- <br />' below set forth; and <br />WHEREAS, the parties have agreed that the sum of $3,000.00 should be <br />escrowed for the purpose of assuring the performance of the below listed items; <br />' and <br />WHEREAS, the parties to this agreenent agree to use Liberty Title Insurance <br />' Company as the escrow agent and Liberty Title Insurance Company has consented so <br />to act; <br />NOW, THEREFORE, based upon the consideration set forth above and other good <br />and valuable consideration the parties agree as follows: <br />1. The sun of $3,000.00 is hereby delivered into escrow with Liberty Title <br />Insurance Conpany pending release as herebelow provided. <br />2. Funds shall be released from escrow to the builder only upon satisfaction <br />t of the following conditions: <br />(D Five sheets of steel on the outside of the building <br />have been replaced; <br />2. Trim has been touched up and caulked and closures <br />installed; <br />3. Caulking around windows and doors in areas where <br />r on poorly because of cold weather has been <br />accomplished; <br />' Repair of back cement pad has been completed; <br />r ____1 Doors have been readjusted; <br />T ) Closures to be installed in the front of the building <br />under the trim has been accomplished; <br />r �7 Trim around center loading dock door has been replaced; <br />t 8.
