Raatikka, P.E. <br />1 August 22, 1985 <br />' Honorable Mayor and City Council <br />City of Ramsey <br />' 15153 Nowthen Blvd. <br />Ramsey, MN 55303 <br />' Re: Liquidated Damages <br />Project 84 -18 River's Bend <br />1 Dear Council Members: <br />At your August 27, 1985 council meeting, we will be recommending final <br />payment to Forest Lake Contracting on projects 84 -18 and 84 -19. <br />' Based on the project schedule in the contract documents, the street <br />construction in River's Bend was to be completed on May 10, 1985 and the <br />' restoration and final cleanup was to be completed on June 10, 1985. The <br />paving in River's Bend was not completed until May 24, 1985 and the seeding <br />on the project was not completed until June 21, 1985. Therefore, without <br />' any extensions, you could assess the contractor for 25 days of liquidated <br />damages. <br />On June 29, 1985, Mr. Spengler from Forest Lake Contracting, Inc. sent me <br />' the attached letter requesting an extension of time. Article 22 of the <br />General Contract Conditions allows the contractor to make a claim for an <br />extension in the contract time. The claim is to be submitted in writing to <br />' the engineer within five (5) days of the occurrence of the event giving <br />rise to the claim. <br />' The request for the extension of time was not within (5) days of the <br />occurrence, and could be rejected. However, since the contractor made a <br />determined effort to complete the paving by May 10, 1985, we would <br />recommend the contractor be granted 8 extra days for completion on the <br />' paving based on the following: <br />1. Sewer and Water Contractor: 1 day - one day for delay in the plat due <br />' to the testing of the watermain and delay for crossing 142nd <br />Avenue with sewer. <br />' 2. Utility Contractor: 0 days - we have re- evaluated the delays by <br />the utility contractors and conclude that they did not cause any <br />substantial delays.
