' Honorable Mayor and City Council
Page Two
August 22, 1985
t 3. Developer Delays: 3 days - based on extra material to be moved
due to the subgrade being out of tolerance, this amounted to
t approximately three extra days of work. No extra days for slow
downs caused by the developer's landscaping and building
contractors were allowed since the contractor did not complain of
the problem during construction. The developer also stated he
' offered to clear the street if there were problems.
4. Change Orders: 2 days - based on Section 1806.2 of the Mn /DOT
' specifications, an extension of time can be granted for extra work.
Using the original contract amount and the anticipated overruns or
change orders, we would recommend an extension of 2 days.
1 5. Rain Days: 2 days - April 23, 1985, and May 15, 1985.
By deleting the 8 days for paving, the overun on the project was six days
' for paving and 11 days for the seeding. Therefore, the City could assess a
total of 17 days for liquidated damages at $300 per day or $5100.00.
' We will be present at your August 27, 1985 council meeting to answer any
questions you may have in regard to this issue.
' Sincerely,
HAKANSON ANDERSON ASSOCIATES, INC.
1
1
1
1
1
1
1
1
Peter R.
