' /layor Heitman moved the adoption of the following findings <br />of fact, <br />' FI IMS OF FACT 0114 <br />MR. OMM JCHNSM <br />' 1. That the Applicant has applied for a Board of Adjustment <br />variance to construct an accessory structure larger than allowed <br />by City Code. <br />' 2. That the Applicant appeared before the Board of Adjustment <br />for a public hearing on July 23, 1985, and that said public <br />hearing was properly advertised and that the minutes of said <br />' public hearings are hereby incorporated as a part of these <br />findings by reference. <br />' 3. That the Applicant's property is generally knwon as 7241 <br />164th Lane N.W. and is located in an R -1 Residential District. <br />' 4. That the subject property is less than 2 -1/2 acres in size. <br />S. Tha the Applicant's request is to construct a 32' : 40' <br />accessory structure with an area of 1,280 square feet. The <br />proposed accessory structure will be used for the storage of the <br />Applicant's motor home, boat, snowmobiles, and other personal <br />property. <br />' 6. That the City Code restricts the total square footage of an <br />accessory structure to 624 square feet maximum on parcels of land <br />' less than 2 -1/2 acres. <br />7. That there may be exceptional, unique or extraordinary <br />circumstances or conditions applying to the property in questions <br />as to the intended use of the property that do not apply <br />generally to other properties in the same zoning district. <br />' 8. That such variance may be necessary for the preservation and <br />enjoyment of a substantial property right similar to that <br />possessed by other properties in the same district and in the <br />same vicinity. The possibility of increased financial return <br />shall not in itself be deemed sufficient to warrant a variance. <br />9. That the authorization of such variance will not be of <br />' substantial detriment to adjacent ,property and will not <br />materially impair the intent or purpose of this ordinance or the <br />public interest. <br />10. That the condition or situation of the subject property, or <br />the intended use of the property for which the variance is <br />' sought, is not of so general or recurrent a nature as to make <br />reasonably practicable the formulation of a general regulation <br />for such conditions or situation. <br />' 11. That the variance may observe the spirit and intent of the <br />ordinance, may produce substantial justice and may not be <br />' contrary to the public interest. <br />
