creates the total element of the site; the unite would then be shielding Anoka <br />residents from headlight glare and help to create a better barrier than if they <br />were not plaoed there. <br />Mr. Richey stated that ENR ruled the way they did because the oxbow peninsula <br />is in the 100 year flood. <br />Mayor Heitman inquired if the developer has an alternative land use in mind if <br />the proposed development proves not to be economically feasible. <br />Mr. Leonard McLaughlin stated that one alternative would be a strip shopping <br />center. <br />Mr. Richey stated that the chances of a shopping center are remote because of <br />DNR restrictions. <br />Mr. McLaughlin stated that there is a Food 'n' Fuel going in that area already. <br />Mr. Richey stated that he talked to ERR today and they have seen nothing <br />regarding a Food 'n' Fuel going into that area. <br />(buncilmestber Reimann brought up the subject of drainage. <br />Mr. Dennis Miller stated that the drainage issue has been reviewed with Dt1R and <br />there should be no problems. The development site will pull drainage off of <br />surrounding residential properties onto the site's holding Fond; the holding <br />pond on Hwy. #47 overflows into the Highway Departments drainage easement along <br />Hwy. #47; drainage out of the second pond in the southeast corner is set below <br />the property lines of adjacent properties and overflows into the river. Mr. <br />Miller added that developing the site should alleviate the problems Mrs. Olson <br />is having with trespassing because the developer will be controlling access <br />through the site. <br />Mr. Leonard McLaughlin stated that the proposed apartments appear to be a <br />townhcme arrangement; the apartments have attached garages, individual <br />entrances, individual footprints and are aimed at the upper income rent bracket <br />to match River's Bend; there will be no above or below residences. <br />Mr. Richey stated that Anoka grants variances based on hardship and the burden <br />of proof is on the developer. <br />Mr. Goodrich read the City's ordinance regarding variance requirements. <br />Council proceeded to review the proposed findings of fact. <br />Mr. Schnelle stated that the development will enhance Ramsey and Council should <br />table the case and review the site plan prior to making a decision. The land <br />has been zoned for this density since 1978, at which time a public hearing was <br />conducted. <br />Mr. Miller stated that the courts ruled that Edina was acting capriciously in <br />requesting documents not normally required prior to taking action. <br />July 23, 1985 <br />Page 2of7 <br />
